RENTAL AGREEMENT

MOTO AUTO PLAKIAS hereby rents Vehicle (including any replacement vehicle) to Renter subject to all terms and conditions on the front page and this page and Renter in considera-tion thereof agrees to them as the essence of the Agreement.

1. DELIVERY and RETURN.

The vehicle is delivered to the Renter in good overall condition and without apparent de-fects. Delivery and return of the vehicle can be done only at the place, date and time which is written on the rental agreement. Delivery of the vehicle in a different place that it was agreed on the rental agreement will be charged 60 EURO. It is strictly forbidden to transfer the vehicle out of the territory of the island of CRETE, except only if it is approved from the company and written on the rental agreement.

If the Renter do not return the vehicle within (24 hours) from the date of delivery which is writ-ten on the rental agreement this means THEFT of the vehicle and the renter will be prose-cuted by the police and the law.

MOTO AUTO PLAKIAS reserves the right to repossess the vehicle at any time without de-mand at Renter’s expense, if vehicle is used in violation of the agreement.

2.  DAMAGE etc.

If Renter has complied with all terms and conditions of this agreement, it will not be other-wise Renter’s responsibility for direct and accidental loss or damage from collision is WAI-VED by MOTO AUTO PLAKIAS when Renter accepts Collision Damage Waiver at time of rental by initialling in the «Accept» box on the reverse side of this page. If Renter does not accept CDW, his responsibility remains.

3. CHARGES

The Renter is responsible for any amount for replacement of destroyed tyres, repairing me-chanical damages and wear and tear of the body of the vehicle.

The gasoline is paid by the Renter in any case.

For every delivery of the vehicle away of the Company’s office there is an extra charge (amo-unt of money) which depends from the distance and the time of delivery.

4. CONDITIONS OF USE

The Renter is expected to look after the vehicle carefully, to check its mechanical condition, oil, water, tyres etc. Any repair of the vehicle by Renter himself or any other party designa-ted by Renter is not allowed without a leasing company’s prior consent.

In particular, vehicle must not be used:

1. To carry persons or property for b) To propel or to tow any vehicle, trailer or other ob-ject. c) In race test or contest. d) For subleasing or giving by Penter to any third party. e) While Renter or any other authorised driver of the vehicle is under the influence of alcohol, nallucinatory drugs, barditurates, or any other substance impairing his consciousness or abi-lity to react.

5. EXTENSION OF RENTAL PERIOD

If Renter wishes to prolong the rental period of the vehicle, he has to contact MOTO AUTO PLAKIAS 48 hours before the initial expiration time of the rental to obtain permission for the additional rental period, failing to do so will make Renter liable civilly and penally for illegal use and possession of the vehicle. In case of extension Renter shall be bound by the terms and conditions agreed by MOTO AUTO PLAKIAS or in respect of any replacement vehicle rented in lieu «of the vehicle».

6. ACCIDENTS

In case of an accident or any other incident (fire, theft etc) Renter is responsible for following the insurance procedures urgently, as set out below:

7. INSURANCE TERMS & CONDITIONS

Full Insurance without excess with attention to the exceptions (Collision Damage Waiver – C.D.W.) covers:

1. Third party (personal liability) up to a total of EUR 1,300,000.
2. Material Damage up to a total of EUR 1,300,000.
3. Material damage caused by an uninsured vehicle up to EUR 000.
4. Legal protection up to EUR 000.
5. Personal accident insurance limit for the driver up to EUR 12,000.

8. MISCELLANEOUS

Vehicle is the property of MOTO AUTO PLAKIAS. This is an agreement of rental only. Ren-ter is not Lessor’s agent for any purpose. Renter acknowledges that he acquires no rights other than stated in this agreement. All additional authorised drivers are jointly and severally liable with the Renter under this agreement.

Driver prerequisites: 21 years and older, holding a driving license for at least 1 year. Driver(s): ONLY registered customers listed in the rental contract can drive the vehicle.

Off-road (off-asphalt) there is no insurance coverage, therefore any damages of the vehicle or extra costs regarding you and the vehicle will be covered by the renter.

Balos Beach is off-limits and violates our terms of car usage. The vehicles may or may not be tracked via GPS trackers.
